Construction work is one of the three most dangerous
occupations in the United States. Each year hundreds of thousands of disabling injuries
and deaths occur at construction projects. Since 1994, construction site personal injuries
have been on the increase as construction companies ignore basic safety rules and require
workers to lift loads with worn and weathered cables; to work at height with no fall
protection or with old, worn safety harnesses and improper lanyards; to work in trenches
with improper benching or grading and without shoring or trench boxes; to use defective
tools and equipment; and repeatedly subject construction workers to unsafe work practices
and unsafe worksite conditions.
Construction site personal injury law is a unique and
specialized area of the law in which few lawyers practice and which even fewer lawyers
understand. Unless the injured construction worker is represented by an attorney
knowledgeable in a variety of construction techniques, OSHA and other applicable safety
standards, the personal injury claim may often go unrecognized and the injured worker will
not receive a full, fair and complete recovery for his injuries but will only receive the
limited amount offered through workers' compensation.
